ALBUQUERQUE, N.M. (AP) — A wrongful death lawsuit filed against a former Albuquerque police officer who was acquitted in his wife’s shooting death has been dismissed.
The family of Tera Chavez tells KOB-TV (http://bit.ly/18JIHej ) that they have agreed to dismiss the lawsuit against Levi Chavez because extracting funds from his household for the legal fight would only harm their grandchildren.
The civil case was scheduled for trial next month.
Tera Chavez was found dead in the couple’s home in 2007 from a gunshot wound to the head. Police had accused Levi Chavez of shooting her and making it look like a suicide.
In July, jurors acquitted Chavez of the criminal charges related to his wife’s death.
Chavez had said he couldn’t afford an attorney to defend himself against the civil lawsuit.
