Stepfather gets prison time for NM boy’s death

ALBUQUERQUE, N.M. (AP) — A New Mexico man has received the maximum sentence for killing his 5-year-old stepson.

Albuquerque television station KOAT reports ( Richard Gutierrez was sentenced Monday to 36 years in prison, with [auth] six of those years suspended. He was charged with child abuse resulting in death, kidnapping and tampering with evidence.

The charges stem from an incident last year. Gutierrez initially told dispatchers that his stepson, Isaiah Ithurria, had been injured in a fall from his bed.

Police said Gutierrez later told officers that he became angry after learning the boy had lied about wetting his pants and threw him against a bedroom dresser. The boy died from his injuries.

Several of Ithurria’s family members spoke at Monday’s sentencing and pleaded with the judge for the maximum sentence.
