Judge orders Albuquerque officer reinstated

ALBUQUERQUE, N.M. (AP) — A state judge has ordered a [auth] fired Albuquerque police officer to be reinstated.

The Albuquerque Journal reports ( ) the ruling came this week in the case of Russell Perea. He was fired in 2011 after department officials said he was untruthful about his activity and conversations with former officer Levi Chavez the night Chavez’s wife was found dead.

Perea and Chavez had been partners for four days when Tera Chavez was found dead in her home. Levi Chavez was acquitted this summer after a high-profile murder trial.

Judge Shannon Bacon upheld a personnel board hearing officer’s opinion that the inconsistencies in Perea’s account were due to faulty memory and that time log evidence was inconclusive.

Perea’s attorney says he hopes the city complies with the order as soon as possible.
