LAS CRUCES, N.M. (AP) — A Las Cruces man convicted in a 2005 accident that killed a woman has been arrested in an Aug. 14 hit-and-run crash that killed a bicyclist.
Las Cruces police say [auth] 28-year-old Jeffrey Nieto was arrested Thursday on charges of careless driving, leaving the scene of an accident that caused great bodily harm or death, and tampering with evidence.
The charges stem from the accident that killed 57-year-old Terence Patrick Havey.
According to police, Nieto was reaching for his cellphone when the accident occurred.
Court records indicate that Nieto served a prison term after pleading no contest to felony charges resulting from the Sept. 29, 2005 rollover crash that fatally injured a passenger in his vehicle, Erica Chavarria.
It’s not immediately known whether Nieto has an attorney.
