Man dies in RPD custody

The Roswell Police Department reported an in-custody death that occurred early Monday morning. Officers were dispatched to the 1600 block South Union Avenue around 2 a.m. following a call reporting a disorderly subject.

According to RPD spokeswoman Sabrina Morales, when officials arrived the scene, they confronted Cody Towler, 38, in the alley. He was [auth] beating on a trash can with a baton. She said the officers asked the subject to put down the stick.

Towler resisted attempts to arrest him. “The officers managed to detain him and he collapsed,” said Morales

Roswell Emergency Services were called to the scene and informed the officers that the man was dead.

The body has been sent up to the Office of Medical Investigators in Albuquerque for autopsy. The investigation of the incident has been put in the hands of a combined law enforcement taskforce which includes the New Mexico State Police, the Chaves County Sheriff’s Office and the RPD.

“The officers have been placed on paid administrative leave pending the completion of the investigation,” said Morales.

Sheriff Rob Coon explained that when an incident such as this occurs, a taskforce of the three agencies is standard procedure. He noted that the investigation not be completed until OMI determined the exact cause of death.
