Residents who have received notices regarding a class action lawsuit against Eastern New Mexico Medical Center are advised to read the document carefully, as they may be entitled to a substantial refund.
The lawsuit alleges that the hospital overcharged patients for services rendered between April 15, 2003, and April 15, 2009.
The agreed terms of settlement provide for a refund of approximately $4.4. million distributed among all those affected, according to an affidavit filed Thursday with the District Court Clerk obtained by the Roswell Daily Record.
Earlier this year, 12,036 notices about the settlement and refund claim had been mailed, but as of Oct. 26, 2012, 2,348 claims, with the potential refund amount of $1.3 million, had been returned to the claims administrator.
More than $3 million is still available to claim.
Those who have received notices are encouraged to return their refund claims and release forms to receive all refunds to which they may be entitled.
Those who may have thrown the notice away should know that their claim is not lost and it is not too late to make a claim.
